Drug Possession & Trafficking

How Can Rehab Affect My Drug Possession Charge?

In the state of Texas, all forms of drug possession charges can majorly affect your personal life with serious consequences. Whether it is a misdemeanor or a more severe charge, being found in possession of any illegal prescription medication, marijuana, or other controlled substances will result in harsh penalties in Texas counties. Choosing to go to a rehabilitation center, however, can change your punishment and conviction for the better.

What Will Rehab Do for My Drug Charge?

If you have committed a non-violent drug possession crime and face criminal charges, there’s a good possibility that a judge will agree to drug rehabilitation instead of serving jail time. Once you request this option in court, the judge will then review the situation, including any past drug charges. This will demonstrate to the judge both your willingness to change your life situation and your acknowledgement that what you did was wrong and your willingness to seek treatment to improve your life outcome. Another option is to actually seek rehab treatment before you step foot in the courtroom. If you and your Dallas criminal defense lawyer can prove to the court that you are evaluating your life and decisions and you are already actively seeking change, your charge can be altered. This will depend on your charges and if the judge still thinks that you will need (more) treatment.

The Dallas area has around 40 different rehabilitation facilities. Texas’s geographical closeness to Mexico makes it a target for drug smuggling and trafficking. However, the state’s law enforcement has cracked down on controlling drug abuse, and so the overall use of illegal substances is lower than in other surrounding states. Along with the rehab centers, the Texas Department of State Health Services also provides a funding program for those needing addiction or abuse-related therapies.
