What Should I Do If I Have A Concealed Carry Weapon And I Am Stopped By The Police?

If you have a weapon in the car, even with a permit you’ll want to let the police office know. The police will run your license and see that you have one. In most cases if you simply tell them, you’re gonna be okay. Attorney Mike Goolsby suggests that when a police officer approaches you basically hand them your license and tell them you have a weapon in your car. That you’re a concealed and carry holder and your weapon is in your console, it’s in your bag, or it’s sitting right next to you. You want to make sure you also let them know where it is so that they don’t feel threatened. A common issue Goolsby commonly sees is somebody who has a conceal and carry license or who has their gun legally in their car who is also committing another offense other than speeding or something similar. It’s unlawful to have that weapon if you were charged with possessing marijuana, or DWI.

Well, I always recommend if you’ve got a weapon in the car, even if you’ve got a permit you’re gonna want to let the police office know because what’s gonna happen is, is they’re gonna run your license and they’re gonna see that you have one, and they’ll feel threatened. But most cases if you simply tell them, you’re gonna be okay. Usually what I tell people to say or to do is when a police officer approaching you basically hand them your license and you say officer I have a weapon in my car man I’m a concealed and carry holder and my weapon is in my console, it’s in my bag, it’s sitting right next to me. You want to make sure you also let them know where it is so that they don’t feel threatened every time you make a movement, because if you start, you know making movements, all of a sudden they feel threatened, and you don’t want them pulling their gun on you. You know one of the issues that we commonly see is somebody who has a conceal and carry license or who has their gun legally in their car and if they’re committing another offense other than like speeding or something then it’s unlawful to have that weapon. So for example if you were charged with possessing marijuana, or DWI, even though you are legally and lawfully allowed to have that gun, with a mindset a concealer carry license or just hidden in your car, then it becomes an offense just simply because you’ve been charged with another crime. So you also have to make sure that when you have a weapon that you are making, you know you’re not committing any new offenses so that you can’t be charged with an offense.
