As strange as it seems, I have seen several times where one person is charged with theft and they didn’t actually take anything. This happens in many cases where two friends are in a store together. One is shoplifting while the other is simply standing there. In the Dallas area, this makes you equally as guilty under what is called the law of parties.
In order for you to be found guilty under the law of parties, the District attorney’s office still must show that you had knowledge that the theft was taking place. If you did know your friend was shoplifting, the only way you would not be charged is if you took action to stop the theft at the time it was occurring.
