There are three standardized field sobriety tests. They are:
- HGN (the pen test) – This is the test where the officer moves a pen or flashlight back and forth in front of your eyes.
- One Leg Stand – Here you are required to raise one of your feet 6” of the ground for approximately 30 seconds.
- Walk and Turn – you walk 9 steps down an imaginary line and turn around and walk 9 steps back.
These DWI tests are set up for failure. Although you may think you did well on these tests, any “bobble” or fractional hesitation is enough.
These “clues” are very subjective and open for interpretation by the very person who is looking to arrest you for DWI.
